This article outlines a normative account of unions and justice. It aims to justify this account by showing how it deals with issues of consent, democracy and civil society, distributive justice, the separation of powers, the theory of the firm and the insider-outsider problem. The argument proceeds in two stages. First, the societal effects of unions are investigated from the perspective of Rawls’s theory of justice. Here the values of consent, distributive justice, democracy and civil society are brought into the analysis, Second, problems regarding local justice are examined and a theory of the employment relationship is put forward, bringing the doctrine of the separation of powers into contact with the theory of the firm. Then the paper investigates whether what has been said during the two stages of the argument, regarding institutional design and the norms of the employment relationship, cohere. Here, it is shown that there are empirical and theoretical reasons to think that that the insider-outsider problem is less pressing than it might appear, and it is argued that for situations where such a problem appears, unions need an ethic of the kind provided by the account of unions and justice that is proposed in this article.
